The terms “we”, “us” and “our” refer to Maestrat Cycling Limited (Company Registration Number 17296201), trading as Maestrat Cycling.

Maestrat Cycling operates this website and online store, including all related information, content, features, tools, products and services (the “Services”). Our Services are powered by Shopify, which enables us to provide a secure online shopping and booking experience.

These Terms of Service (“Terms”) govern your use of our website, online store and Services.

Please read these Terms carefully, as they contain important information regarding your legal rights, responsibilities, warranty disclaimers and limitations of liability.

By accessing, browsing or using our Services, or by purchasing any product or service through our website, you agree to be bound by these Terms together with our Privacy Policy, Cookie Policy, Refund Policy and any other policies referenced within these Terms.

Bookings for cycling holidays and related travel services are also governed by our separate Booking Terms & Conditions. In the event of any conflict between these Terms of Service and the Booking Terms & Conditions in relation to a holiday booking, the Booking Terms & Conditions shall prevail.

If you do not agree to these Terms, you must not use our Services.


SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your country of residence.

Participation in our guided cycling holidays is restricted to individuals aged 18 years or older, unless we have provided our prior written consent.

To access certain features of the Services, including placing orders or booking holidays, you may be required to provide information including your:

  • Name
  • Email address
  • Telephone number
  • Billing address
  • Payment information
  • Emergency contact details (where applicable)
  • Other information reasonably required to provide our Services

You represent and warrant that all information you provide is accurate, current and complete, and that you have the legal authority to provide such information.

You are responsible for maintaining the confidentiality of your account credentials and for all activity carried out under your account.

Accounts may not be transferred, assigned or sold without our prior written consent.

We reserve the right to suspend or terminate any account that contains false information, is used fraudulently, or breaches these Terms.


SECTION 2 – OUR PRODUCTS AND SERVICES

We make every reasonable effort to ensure that descriptions, specifications, itineraries, routes, accommodation details, photographs and pricing appearing on our website are accurate.

However:

  • photographs are illustrative only;
  • accommodation, bicycles and equipment may vary from those shown;
  • cycling routes may change;
  • guide availability may vary;
  • weather and local conditions may affect the services provided.

Our guided cycling holidays involve outdoor activities that are dependent upon weather conditions, local regulations, road conditions and operational requirements.

Accordingly, we reserve the right to alter:

  • routes;
  • accommodation;
  • guides;
  • support vehicles;
  • cycling itineraries;
  • start times;
  • services included within a package,

where reasonably necessary to ensure safety or the successful operation of a holiday.

Such changes do not automatically entitle a customer to a refund and are subject to our Booking Terms & Conditions.

We also reserve the right to discontinue, modify or replace any product or service at any time without prior notice.


SECTION 3 – ORDERS AND BOOKINGS

When you place an order or make a booking through our website, you are making an offer to purchase products or services from Maestrat Cycling.

Your order or booking is not accepted until we confirm acceptance by email.

We reserve the right to refuse or cancel any order or booking at our reasonable discretion, including where:

  • products or services are unavailable;
  • pricing errors have occurred;
  • payment cannot be authorised;
  • fraud is suspected;
  • incorrect information has been supplied.

Bookings for cycling holidays may be made by:

  • paying the full booking amount; or
  • paying the required 30% deposit where available.

Where a deposit option is selected, the remaining balance must be paid in accordance with our Booking Terms & Conditions.

Detailed payment schedules, cancellation rights, amendment requests and refund provisions are contained within our separate Booking Terms & Conditions.

Holiday bookings remain subject to availability until confirmed by us.

You represent that all bookings are made for personal use and not for resale or commercial purposes.


SECTION 4 – PRICES AND BILLING

Prices displayed on our website are subject to change without notice.

The price applicable to your purchase will be the price displayed at the time your order is submitted.

Unless expressly stated otherwise, prices may exclude:

  • taxes;
  • customs duties;
  • import charges;
  • shipping costs;
  • optional extras.

Holiday prices include only those items specifically described within the relevant booking package.

Optional services, including bicycle hire, airport transfers, coaching, merchandise or additional accommodation, may incur additional charges.

You agree to provide accurate billing and payment information for every purchase.

By submitting payment details, you confirm that:

  • you are authorised to use the chosen payment method;
  • all payment information supplied is accurate;
  • sufficient funds are available to complete the purchase.

Failure to complete payment when due may result in cancellation of your booking in accordance with our Booking Terms & Conditions.


SECTION 5 – SHIPPING, DIGITAL DELIVERY AND HOLIDAY CONFIRMATIONS

Physical merchandise purchased through our website will be shipped using appropriate delivery providers.

Delivery estimates are provided in good faith but are not guaranteed.

We are not responsible for delays caused by:

  • courier companies;
  • customs authorities;
  • weather;
  • strikes;
  • events outside our reasonable control.

Risk in physical goods passes to you upon delivery.

Holiday confirmations, booking confirmations, vouchers, itineraries, GPS routes and similar digital documents may be delivered electronically by email.

It is your responsibility to ensure your contact details remain accurate and to notify us if you do not receive booking documentation.


SECTION 6 – INTELLECTUAL PROPERTY

All content made available through the Services, including but not limited to text, photographs, videos, route descriptions, GPS files, maps, graphics, logos, branding, software, designs, itineraries, ride plans, training materials and other content is owned by or licensed to Maestrat Cycling Limited and is protected by copyright, trademark and other intellectual property laws.

You may use the Services solely for your personal, non-commercial use.

You must not, without our prior written permission:

  • copy, reproduce or republish any content;
  • sell or commercially exploit any content;
  • distribute GPS routes or itineraries;
  • create derivative works;
  • modify or adapt our materials;
  • use our branding, logos or trademarks;
  • use our photography or videos for commercial purposes.

Nothing contained within these Terms grants you any ownership rights in our intellectual property.

All rights not expressly granted are reserved.


SECTION 7 – OPTIONAL TOOLS

The Services may include access to tools, applications or software provided by third parties.

These tools are provided “as is” and “as available”.

We neither control nor monitor these third-party services and make no warranties regarding their availability, performance or suitability.

Your use of any optional third-party tool is entirely at your own risk.

Future tools or features introduced by Maestrat Cycling will also form part of the Services and will be subject to these Terms.

Our website may contain links to third-party websites, accommodation providers, mapping services, airlines, tourism organisations or other external services.

We are not responsible for:

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Maestrat Cycling is powered by Shopify, which enables us to provide the Services to you. However, all purchases and bookings made through this website are made directly with Maestrat Cycling Limited.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any purchase, booking or transaction between you and Maestrat Cycling.

You expressly release Shopify and its affiliates from any claims, losses, damages or liabilities arising out of purchases or bookings made through our website.


SECTION 10 – PRIVACY

Your privacy is important to us.

All personal information collected through the Services is handled in accordance with our Privacy Policy.

By using the Services you acknowledge that you have read and understood our Privacy Policy.

Where the Services are hosted by Shopify, certain personal information will also be processed by Shopify in accordance with Shopify’s own Privacy Policy.

If you submit suggestions, reviews, testimonials, photographs, videos, comments or other feedback to us, you grant Maestrat Cycling a perpetual, worldwide, royalty-free, transferable licence to use, reproduce, edit, publish, display and distribute such content for any lawful business purpose.

You confirm that:

  • you own the content you submit;
  • you have permission to submit it;
  • it does not infringe the rights of any third party.

We are under no obligation to publish, maintain or respond to any feedback submitted.


SECTION 12 – PHOTOGRAPHY AND VIDEO

During our cycling holidays, coaching sessions and events, we may take photographs and video recordings for promotional and marketing purposes.

These may be used on:

  • our website;
  • social media channels;
  • brochures;
  • advertising materials;
  • promotional videos;
  • printed publications.

If you prefer not to appear in promotional material, please notify us before or during your holiday.

We will make reasonable efforts to respect your request wherever practical.


SECTION 13 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be typographical errors, inaccuracies or omissions relating to product descriptions, accommodation, itineraries, pricing, availability or other information.

We reserve the right to correct such errors and to change or update information without prior notice.

Where an obvious pricing error has occurred, we reserve the right to cancel the affected booking or order and provide an appropriate refund.


SECTION 14 – PROHIBITED USES

You may use our Services only for lawful purposes.

You must not:

  • breach any applicable law;
  • misuse our website;
  • interfere with the operation of the Services;
  • attempt unauthorised access to our systems;
  • upload malicious software;
  • transmit harmful code;
  • impersonate another person;
  • collect personal information belonging to others;
  • use automated scraping software or bots;
  • copy or reproduce our content without permission;
  • use our routes, itineraries or training materials for commercial purposes;
  • misuse our trademarks or branding.

Any breach of these Terms may result in suspension or termination of your account without notice.

This section applies where software agents, automated services or AI systems access the Services.

Such systems must clearly identify themselves where technically possible and must not attempt to bypass security measures, CAPTCHAs or other access controls.

We reserve the right to restrict or block automated access to the Services at any time.


SECTION 16 – PARTICIPATION IN CYCLING ACTIVITIES

Participation in cycling activities requires a reasonable level of physical fitness.

By booking a cycling holiday or participating in any cycling activity organised by Maestrat Cycling you confirm that:

  • you are at least 18 years of age unless otherwise agreed by us in writing;
  • you are medically fit to participate;
  • you will follow the instructions of our guides;
  • you understand that cycling involves inherent risks.

Guests may either:

  • bring their own bicycle; or
  • hire a bicycle from Maestrat Cycling where available.

Approved cycling helmets must be worn during all guided rides organised by Maestrat Cycling.

Travel insurance suitable for cycling activities is mandatory for all holiday participants.

SECTION 17 – GUIDE AUTHORITY

Our ride leaders and guides are responsible for maintaining the safety and enjoyment of all participants.

A guide may, in their reasonable judgement:

  • alter a route;
  • shorten a ride;
  • postpone or cancel a ride;
  • refuse participation;
  • remove a participant from an activity,

where they believe doing so is necessary for safety, health, operational reasons or the wellbeing of the group.

Failure to follow guide instructions may result in removal from an activity without refund, subject to our Booking Terms & Conditions.


SECTION 18 – TERMINATION

We reserve the right to suspend or terminate your access to the Services, your account, or any booking where you breach these Terms, engage in fraudulent or unlawful activity, misuse the Services, or where continued provision of the Services would be inappropriate or unlawful.

Termination of access to the Services does not affect any rights or obligations that arose before termination, including any payment obligations.

We do not guarantee that:

  • the Services will always be available;
  • the website will be uninterrupted;
  • the Services will always be secure or error-free;
  • defects will always be corrected.

Nothing in these Terms excludes any statutory rights that cannot lawfully be excluded.


SECTION 20 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, Maestrat Cycling Limited, its directors, officers, employees, contractors, guides, affiliates, agents and service providers shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Services or from any products or services purchased through the Services.

This includes, without limitation:

  • loss of profits;
  • loss of revenue;
  • loss of enjoyment;
  • loss of business;
  • loss of data;
  • loss of opportunity;
  • travel disruption;
  • accommodation costs;
  • transport costs;
  • indirect financial loss.

Our liability in relation to holiday bookings, guided rides and cycling activities is further governed by our separate Booking Terms & Conditions.

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • any liability that cannot lawfully be excluded under the laws of England and Wales.

SECTION 21 – FORCE MAJEURE

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control.

These include, but are not limited to:

  • severe weather;
  • flooding;
  • wildfire;
  • natural disasters;
  • pandemics;
  • government restrictions;
  • strikes;
  • road closures;
  • civil unrest;
  • acts of terrorism;
  • power failures;
  • transport disruption;
  • supplier failure;
  • guide illness or injury;
  • any other event outside our reasonable control.

Where such circumstances affect a holiday booking, your rights will be governed by our Booking Terms & Conditions.


SECTION 22 – INDEMNIFICATION

You agree to indemnify, defend and hold harmless Maestrat Cycling Limited, its directors, employees, guides, contractors, affiliates, partners, licensors, service providers and Shopify from any claims, losses, liabilities, damages, costs and expenses (including reasonable legal costs) arising from:

  • your breach of these Terms;
  • your misuse of the Services;
  • your breach of any applicable law;
  • your infringement of the rights of another person.

SECTION 23 – SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision shall be severed from the remaining Terms without affecting the validity or enforceability of the remaining provisions.


SECTION 24 – WAIVER AND ENTIRE AGREEMENT

Failure by Maestrat Cycling to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

These Terms, together with our:

  • Refund Policy;
  • Booking Terms & Conditions (where applicable); and
  • any other policies expressly referred to on this website,

constitute the entire agreement between you and Maestrat Cycling regarding your use of the Services.


SECTION 25 – ASSIGNMENT

You may not assign, transfer or delegate your rights or obligations under these Terms without our prior written consent.

We may assign or transfer these Terms or any of our rights or obligations where reasonably necessary, including as part of a business sale, merger or corporate restructuring.

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

Any dispute arising out of or in connection with these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We reserve the right to amend these Terms from time to time.

The latest version will always be published on this website.

Material changes will take effect from the date specified in the updated Terms.

Your continued use of the Services after any changes become effective constitutes your acceptance of the revised Terms.
